1. Acceptance of Terms

By accessing and using Vaidra ("Service"), accessible at vaidra.in, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms comply with the Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable laws of India.

2. Description of Service

Vaidra provides AI-powered educational resources, study materials, and tools to help users prepare for UPSC examinations. Our services include:

• AI-powered study assistance (UPSC GPT)
• Mains answer evaluation with AI feedback
• Prelims mock tests and test generator
• Current affairs updates (daily, weekly, monthly)
• Government schemes database with AI maps
• Previous year papers and practice puzzles
• Progress tracking and analytics
• Personalized study recommendations

3. User Accounts

3.1 Account Creation

You may create an account using your email address or through third-party authentication providers (Google, Facebook). You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

• You must be at least 18 years old to use our Service. Users under 18 must obtain parental or guardian consent
• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use
• One person may only create one account

4. User Conduct

You agree NOT to:

5. Intellectual Property

All content, features, and functionality on the Service (including text, graphics, logos, images, and software) are owned by Vaidra or our licensors and are protected by copyright, trademark, and other intellectual property laws of India.

5.2 Your Content

You retain ownership of any content you create or upload (notes, answers, responses, etc.). By using our Service, you grant us a non-exclusive, worldwide license to use, store, and display your content solely for providing and improving the Service.

6. Subscriptions and Payments

6.1 Subscription Plans

We offer both free and paid subscription plans. Paid subscriptions provide access to premium features and content. Subscription fees are billed in advance on a recurring basis. All payments are processed securely through Razorpay, our payment service provider.

6.2 Refunds and Cancellation

In accordance with the Consumer Protection Act, 2019, you have the right to request a refund within 7 days of purchase if you have not substantially used the service. After this period, subscription fees are generally non-refundable. You may cancel your subscription at any time, but you will continue to have access until the end of your current billing period.

6.3 Price Changes

We reserve the right to change our pricing at any time. We will provide at least 15 days advance notice of any price changes, and changes will apply to subsequent billing periods.

6.4 Payment Terms

All prices are in Indian Rupees (INR). Payment processing is subject to Razorpay's terms and conditions. We do not store your payment card information on our servers.

7. Content Accuracy and Disclaimer

While we strive to provide accurate and up-to-date content:

• Content is for educational purposes only
• We do not guarantee accuracy or completeness of all information
• You are responsible for verifying information from official sources
• We are not responsible for exam results or career outcomes
• AI-generated content may contain errors or inaccuracies

8. Termination

8.1 By You

You may terminate your account at any time through your account settings or by contacting us at support@vaidra.in. Upon termination, your data will be deleted within 30 days as per our data retention policy.

8.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide reasonable advance notice when possible, except in cases of serious violations or legal requirements.

10. Indemnification

You agree to indemnify and hold harmless Vaidra and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Complaint Resolution

In accordance with the Consumer Protection Act, 2019 and IT Rules, 2021, we are committed to resolving user complaints promptly:

• We will acknowledge your complaint within 48 hours
• We will endeavor to resolve complaints within 15 days of receipt
• If you are not satisfied with the resolution, you may escalate to consumer forums or appropriate authorities under Indian law

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service at least 15 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:

• Information Technology Act, 2000
• Consumer Protection Act, 2019
• Indian Contract Act, 1872
• Digital Personal Data Protection Act, 2023

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India. However, we respect your right to approach consumer dispute redressal forums under the Consumer Protection Act, 2019.

14. Dispute Resolution

In the event of any dispute:

• We encourage you to first contact us at support@vaidra.in to resolve the matter amicably
• If the dispute cannot be resolved through negotiation, either party may initiate arbitration proceedings in accordance with the Arbitration and Conciliation Act, 1996
• The arbitration shall be conducted in Jaipur, India, in English language
• Nothing in this clause shall prevent you from approaching consumer dispute redressal forums or courts as provided under Indian law

If any provision of these Terms is found to be unenforceable or invalid under Indian law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vaidra regarding the use of the Service and supersede all prior agreements and understandings.
